On April 8, 2011 both the plaintiff and the defendant were driving south on 57. The defen dant decided to pass the plaintiff and when ! he did cases of beer fell out of the back of the truck striking the plaintiff on his motorcycle causing an accident that injured the plaintiff and caused damage to the truck and the motorcycle.
